Because he would have to come back to us before we transferred him. But he couldn't come back to us because we have 3 DPs and not enough space for a core player.
So realistically 2 things happened if he did in fact go through waivers:
1. Vasco fucked us by cutting his loan off when we agreed for the full season so he could come back in the offseason when we don't have to fit under the cap
2. The core player rule being introduced without notice in the middle of the season (which Vanney and Bez openly complained about) fucked us otherwise we could have taken advantage of it
I couldn't care less about him going to Chicago personally but the fact that we got nothing for someone we paid a lot for sucks. Then again it's not my money and 3 million is absolute chump change to MLSE.

I don't buy this because MLS makes rules on the fly. Case and point with the Montreal Impact signing Santiago Gonzalez via the Special Discovery rule which no one ever heard of except when it appeard in a MLS article on their website. Core DP introduced right around the whole LA and dos Santos thing with Omar on 1.2 million. My point is their rules do not seem black and white. Allocation and the such are just ways for teams to circumvent the cap.
If Vasco really blindsided us I would like to think MLS would do us a solid. Since we are one of the few teams going after top talent. Maybe Garber will float us the allocation money we would have gotten if this was a normal transfer. Until till more details come out we are just pulling at strings. Looks bad tho on management and the league.

All the team spent on him was 1 year of cap space and some resources last season that didn't work out.
The 3 million seems lost based on MLS rules. If that's the way MLSE see it, we close this chapter and move on.

I guess LEGALLY speaking MLS owns Gilberto and therefore can allocate Gilberto to Chicago in order to make up for Jones and Drogba, but that does not make it ETHICAL

I liked Gilberto as much as the next person......but our team is better today without him then when he was here.
As for the waiver stuff, who knows. This league works in very funny ways. I get the feeling they worked this for Chicago since they had Drogba rights.
Most likely thing that happened:
- Vasco cancels loan ubruptly and goes back on TFC books.
- Bez can't do shit because he needs to be roster compliant.
- Has to waive him and eat the losses.
This only makes sense if it was in reality the league who paid his transfer fee. It's known now that there's weird funds set up by the league to pay for players' transfer fees when they feel like it. Could be a case where the league paid the fee and we were paying his salary. That would explain why they would have to give him another MLS team rather than sell him.
maybe the league paid the original transfer fee..so maybe they have the say?
Gilberto wasn't an asset. He was a liability. He used a DP slot that we could better use.
He was released from his loan and became a liability again.
If we can't get a bag of balls to take him off our books, then we waive him.
